WILLS FOR FAMILIES
A will is the only legal document where you can decide what will happen to your assets and your children after your death. If you die intestate (without a will) it will be the laws of intestacy that decide who will receive your estate and almost certainly that will not work the way you would have wished.
Why make a will?
To decide who will receive your estate – you can include stepchildren and unmarried partners for example.
To ensure that your spouse partner will receive your assets – not as automatic as you may think.
Appoint guardians for children under 18 – if guardians are not appointed it is the court that decides who looks after your children on the advice of Social Services.
To choose the executors who will deal with your estate and the trustees of the children’s inheritance should they be under 18 at the time of your death. You can choose people you trust.
To protect your children’s inheritance should your spouse or partner remarry or form a new relationship after your death.
To specify any particular funeral arrangements.
To make gifts to charities or friends
Once you have made a will it is important to review it regularly, every 5 years or sooner if there are changes in your circumstances.
It is never too early to make a will, but don't leave it too late!
